Background 300 million operations and procedures are performed annually across the world, all of which require a patient’s informed consent. No standardised measure of the consent process exists in current clinical practice. We aimed to define a core outcome set for informed consent for therapy. Methods The core outcome set was developed in accordance with a predefined research protocol and the Core OutcoMes in Effectiveness Trials methodology comprising systematic review, qualitative semi structured interviews, a modified Delphi process and consensus webinars (...) to ratify outcomes for inclusion in the final core outcome set.. Participants from all key stakeholder groups took part in the process, including patients and the public, healthcare practitioners and consent researchers. Results 36 outcome domains were synthesised through systematic review and organised into a consent taxonomy. 41 semi-structured interviews were performed with all consent stakeholders groups. 164 participants from all stakeholder groups across 8 countries completed Delphi Round 1 and 125 completed Round 2. 11 outcomes met the ‘consensus in’ criteria. 6 met ‘consensus in’ all stakeholder groups and were included directly in the final core outcome set. 5 remaining outcomes meeting ‘consensus in’ were ratified over two consensus webinars. 9 core outcomes were included in the final core outcome set: Satisfaction with the quality and amount of information, Patient feeling that there was a choice, Patient feeling that the decision to consent was their own, Confidence in the decision made, Satisfaction with communication, Trust in the clinician, Patient satisfaction with the consent process, Patient rated adequacy of time and opportunity to ask questions. Conclusion This international mixed-methods qualitative study is the first of its kind to define a core outcome set for informed consent for intervention. It defines what outcomes are of importance to key stakeholders in the consent process and is a forward step towards standardising future consent research. (shrink)

Reasoning patterns found in Galileo’s treatise on machines, On Mechanics, are compared with patterns identified in case studies of scientifically trained experts thinking aloud, and many similarities are found. At one level the primary patterns identified are ordered analogy sequences and special diagrammatic techniques to support them. At a deeper level I develop constructs to describe patterns that can support embodied, imagistic, mental simulations as a central underlying process. Additionally, a larger hypothesized pattern of ‘progressive imagistic generalization’—Galileo’s development of a (...) model or mechanism that becomes more and more general with each machine while still being imagistically projectable into many machines—provides a way to think about his progress toward a modern explanatory model of torque. By unpacking his arguments, we gain an appreciation of his skillful ability to foster imagistic processes underlying scientific thinking. (shrink)

Neurosurgery for psychiatric disorders, also sometimes referred to as psychosurgery, is rapidly evolving, with new techniques and indications being investigated actively. Many within the field have suggested that some form of guidelines or regulations are needed to help ensure that a promising field develops safely. Multiple countries have enacted specific laws regulating NPD. This article reviews NPD-specific laws drawn from North and South America, Asia and Europe, in order to identify the typical form and contents of these laws and to (...) set the groundwork for the design of an optimal regulation for the field. Key challenges for this design that are revealed by the review are how to define the scope of the law, what types of regulations are required, and how to approach international harmonization given the potential migration of researchers and patients. Perhaps more than any philosophy written in the past few centuries, the work of Friedrich Nietzsche has given rise to controversy, misunderstanding, and dissent. Today Nietzsche is remembered as the revolutionary author of such polemical ideas as the death of God, the revaluation of values, the will to untruth, and the Übermensch. Yet is Nietzsche’s philosophy as atheistic, relativistic, nihilistic, and immoral as some commentators have claimed? Or ought we perhaps to give more credence to Nietzsche’s own assertion that one (...) writes books “precisely to conceal what one harbors” (BGE, 9, 289)? If “whatever is profound loves masks” (BGE, 2, 40) then might Nietzsche’s more daring claims be interpreted as clever masks behind which he conceals a deeper philosophy and on which he reveals a hidden truth? Is it not possible that the standard readings of Nietzsche are in fact misreadings—that his work invites misreading, that it is intentionally unclear, deceptive, disguised? The goal of this volume is to reread Nietzsche for all that he shows and all that he hides. It is to dig deeper into his work in order to challenge misreadings of old and invite misreadings anew—as, indeed, his work itself calls for and demands. (shrink)

We show that R.J. Thompson’s groupsFandTare bi-interpretable with the ring of the integers. From a result by A. Khélif, these groups are quasi-finitely axiomatizable and prime. So, the groupTprovides an example of a simple group which is quasi-finitely axiomatizable and prime. This answers questions posed by T. Altınel and A. Muranov in [2], and by A. Nies in [12].

The extraordinary events surrounding the measles, mumps, and rubella vaccine in the United Kingdom have not only placed in jeopardy the use of this triple vaccine but have also spread concern to other parts of the world. Examination of the public’s worry about MMR vaccine reveals they have been exposed to a range of conflicting views resulting in the feeling of having been misled about the safety of the vaccine. There are various groups and individuals who have legitimate roles in (...) informing the public about such subjects. But is each one behaving in an ethically responsible way? And if confidence falters, vaccine coverage dips, and an outbreak of measles, mumps, or rubella ensues, who, if anyone, will stand and say “I misled them, I confused them, this is my responsibility”? We examine the ethical issues of each group with a voice in the debate about vaccine safety. (shrink)

Many of us have lately been reading, hearing or listening in to the present Master of Trinity's Presidential Address to the British Association's meeting at Oxford; and perhaps some reflexions suggested thereby may not be out of place in this number of Philosophy.

This paper aims at bridging a gap between the history of American animal behavior studies and the history of sociobiology. In the post-war period, ecology, comparative psychology and ethology were all investigating animal societies, using different approaches ranging from fieldwork to laboratory studies. We argue that this disunity in “practices of place” explains the attempts of dialogue between those three fields and early calls for unity through “sociobiology” by J. Paul Scott. In turn, tensions between the naturalist tradition and the (...) rising reductionist approach in biology provide an original background for a history of Edward Wilson’s own version of sociobiology, much beyond the William Hamilton’s papers usually considered as its key antecedent. Naturalists were in a defensive position in the geography of the fields studying animal behavior, and in reaction were a driving force behind the various projects of synthesis called “sociobiology”. Corcoran a contribué à diffuser une nouvelle perspective sur les écrits logiques d’Aristote et sur la théorie du syllogisme en particulier. Dans cet article, Corcoran affirme que, dans les premiers chapitres des Premiers Analytiques, Aristote ne propose pas un système axiomatique, qui supposerait une logique sous-jacente, ainsi que le pensait Łukasiewicz, mais plutôt un système de déduction naturelle, avec des dimensions métalogiques. Notre propos est ici basé sur une (...) courte monographie de Kurt Ebbinghaus, intitulée Ein formales Model der Syllogistik des Aristoteles (1964), où est fixé le canon de cette nouvelle perspective mentionnée plus haut et qui a été développé dans le cadre conceptuel de la « logique opérative » de Paul Lorenzen. Ebbinghaus développe une reconstruction formelle montrant que l’approche d’Aristote relève de la « théorie de la preuve », non seulement pour ce qui concerne le système d’inférence sous-jacent, mais aussi pour ce qui concerne les éléments métalogiques. C’est notamment à travers ce dernier aspect que se manifeste une différence majeure par rapport à la reconstruction de Corcoran. Alors que celui-ci pose que le système d’inférence d’Aristote est enraciné dans une sémantique de théorie des modèles (élaborée par Corcoran lui-même), Ebbinghaus comprend que la théorie du syllogisme a été développée à partir d’une approche de la signification par des règles (« rule based »), semblables aux règles d’un jeu. En fait, la reconstruction d’Ebbinghaus offre une lecture pragmatiste de la syllogistique d’Aristote, qui, tel est notre propos, paraît non seulement beaucoup plus proche du point de vue d’Aristote que ne l’est la sémantique de théorie des modèles proposée par Corcoran, mais qui, de plus, permet de saisir l’unité systématique de la théorie du syllogisme. Background: Monitoring the daily change in resting heart rate variability can provide information regarding training adaptation and recovery status of the autonomic nervous system during training camps. However, it remains unclear whether postural stabilization is essential for valid and reliable ultra-short-term recordings in short-term overseas training camps.Design: Observational and longitudinal study.Purpose: This study aimed to investigate ultra-short-term heart rate variability recordings under stabilization or post-stabilization periods in four overseas training camps.Participant: Twenty-seven U-20 male national team futsal players voluntarily participated in (...) this study.Method: Resting HRV was evaluated for 10 min during the early morning of each training camp. The natural logarithm of the root mean square of successive normal-to-normal interval differences was used for comparisons. Time segments of HRV were divided into two periods with three measures within each: the first 30-s, the first 60-s, and the 5-min standard during stabilization; the first 30-s, the first 60-s, and the 5-min standard after stabilization.Result: The results demonstrated trivial to small ES, very large to nearly perfect ICC, and narrow range of SEM when all time segments of HRVUST were compared to the 1st_5 min and 2nd_5 min HRV. Furthermore, the magnitude of the correlation coefficients ranged from very high to nearly perfect for all the time segments. The HRVUST posted excellent agreement in all time segments with/without postural stabilization. Trivial to small levels of effect size in all time segments of LnRMSSDmean and LnRMSSDcv across overseas training camps was identified.Conclusion: The first 30 or 60-s LnRMSSD recordings can be used to evaluate daily cardiac-autonomic function during overseas training camps in futsal players. The process for stabilization seems to be unnecessary for measuring the morning resting LnRMSSD in overseas training camps among young adult futsal players. (shrink)

It is not intended as some sort of revelation on my part that Greenberg's cultural theory was originally Marxist in its stresses and, indeed in its attitude to what constituted explanation in such matters. I point out the Marxist and historical mode of proceeding as emphatically as I do partly because it may make my own procedure later in this paper seem a little less arbitrary. For I shall fall to arguing in the end with these essay's Marxism and their (...) history, and I want it understood that I think that to do so is to take issue with their strengths and their main drift.But I have to admit there are difficulties here. The essays in question ["Avant-Garde and Kitsch" and "Towards a Newer Lacoön"] are quite brief. They are, I think, extremely well written: it was not for nothing the Partisan Review described Clement Greenberg, when he first contributed to the journal early in 1939, as "a young writer who works in the New York customs house"—fine, redolent avant-garde pedigree, that! The language of these articles is forceful and easy, always straightforward, blessedly free from Marxist conundrums. Yet the price paid for such lucidity, here as so often, is a degree of inexplicitness—certain amount of elegant skirting round the difficult issues, where one might otherwise be obliged to call out the ponderous armory of Marx's concepts and somewhat spoil the low of the prose from one firm statement to another. The Marxism, in other words, is quite largely implicit; it is stated on occasion, with brittle and pugnacious finality, as the essay's frame of reference, but it remains to the reader to determine just how it works in the history and theory presented—what that history and theory depend on, in the way of Marxist assumptions about class and capital or even abase and superstructure. That is what I intend to do in this paper: to interpret and extrapolate from the texts, even at the risk of making their Marxism declare itself more stridently than the "young writer" seems to have wished. And I should admit straight away that there are several point in what follows where I am genuinely uncertain as to whether I am diverging from Greenberg's argument or explaining it more fully. This does not worry me overmuch, as long as we are alerted to the special danger in this case, dealing with such transparent yet guarded prose, and as long as we can agree that the project in general—pressing home a Marxist reading of texts which situate themselves within the Marxist tradition—is a reasonable one.22. This carelessness distinguishes the present paper from two recent studies of Greenberg's early writings, Serge Guilbaut's "The New Adventures of the Avant-Garde in America," October 15 , and Fred Orton and Griselda Pollock's "Avant-Gardes and Partisans Reviewed," Art History 3 I am indebted to both these essays and am sure that their strictures on the superficiality—not to say the opportunism–of Greenberg's Marxism are largely right. But I am nonetheless interested in the challenge offered to most Marxist, and non-Marxist, accounts of modern history by what I take to be a justified though extreme, pessimism as t the nature of established culture since 1870. That pessimism is characteristic, I suppose, of what Marxists call an ultraleftist point of view. I believe, as I say, that a version of some such view is correct and would therefore with to treat Greenberg's theory as if it were a decently elaborated Marxism of an ultraleftist kind, on which issues in certain mistaken views but which need not so issue and which might still provide, cleansed of those errors, a good vantage for a history of our culture.T. The ArgumentLevi ben Gerson, also known as Gersonides or Leo de Balneolis, was one of the most original Jewish thinkers of the Middle Ages, and he wrote on logic, philosophy, biblical exegesis, mathematics, and astronomy. During the last years of his life he maintained relations with the papal court of Clement VI (1342–52) at Avignon, and collaborated in the translation into Latin of hisSefer Tekhuna(Book of Astronomy). The object of this paper is to establish the main stages of the redaction (...) of the Hebrew and Latin extant versions of his astronomical work. Although Levi declares that the work was finished in 1328,1 argue that this text was the preliminary draft of the preserved one, most of which was composed after 1338. A thorough revision of the work was undertaken at an indeterminate date before 1344. It is also argued that the final form of the work was probably due to the request of solar and lunar tables made to Levi by “great and noble Christians” around 1332. (shrink)

Dr. Fuad Nucho, a native Jordanian and presently a pastor in Yeadon, Pa., provides us with a lucid and illuminating account of the central problem of freedom in the Christian existentialism of Nicolas Berdyaev. Confident that the thought of Berdyaev, while professedly not a "System," suffers no distortion from an organized and systematized explication, Dr. Nucho orders his work around the problem of freedom conceived of as a paradox demanding resolution. He deals in turn with the nature, implications, and solution (...) of the paradox, after a brief, informative discussion of the influences on Berdyaev's thinking. Critical and evaluatory remarks are reserved for a final chapter, so as not to interrupt the progress of his argument. For Berdyaev, man is a citizen of two worlds, divided between an inclination toward material objects which enslave him, and an aspiration toward the transcendent world of divine freedom. Nature, society, and history all tend to enslave man, yet they are also the theater in which his freedom must be exercised. Man himself is conceived of essentially as a free being. Freedom for Berdyaev means creativity, where creativity is taken in the radical sense of production out of nothing. Hence the alliance of freedom with the "nothing," and so with Boehme's Ungrund. The paradox is resolved only when, first, the world of natural necessity is recognized as perfused with symbol and when, finally, the revelation of Christ is taken as the meaning of that symbolization. Such a liberation comes to historical man in metahistorical moments when he grasps the eternal meaning behind the phenomena of nature and history, that is, when he grasps the end of history and nature. Nucho concludes that Berdyaev is a religious thinker in the tradition of the early Christian Fathers—a modern parallel, in particular, to Clement of Alexandria.—J. D. C. (shrink)

Many natural scientists of the past and the present have imagined that they pursued their activity according to its own inherent rules in a realm distinctly separate from the business world, or at least in a realm where business tended to interfere with science from time to time, but was not ultimately an essential component, ‘because one thought that in science one possessed and loved something unselfish, harmless, self-sufficient, and truly innocent, in which man’s evil impulses had no part whatever’, (...) as Nietzsche once commented (Nietzsche 1974, p.106). With the extreme technological changes that have occurred in the last fifty years and the orchestrated management changes in the culture of science, it is now obvious that science is intimately tied to private businesses, industry, and society. Within this structure, the scientist has generally unknowingly defined him or herself in accordance with obsolete myths that have tended to handicap the scientist’s freedom of action, by obscuring the modern political and economic realities of science, and neglecting the inherent responsibilities of the scientist as a critical actor in the theater of human civilization. The increasing incorporation of academic science and private industry, and the governmentally supervised nature of modem academic science, has corrupted the traditional freedom and character of the scientist. In order to navigate oneself and find meaning within the new structure of science, scientists now desperately need a fresh ethos that at once considers modern realities of the politics and management of science, societal urgencies, and global politics, as well as establishing a moral perspective where modern scientists can be actors with their own intentionality and responsibility. -/- In the culture of science, myths and ideologies are of critical importance for the formation of the scientist, because these ideas determine how scientists conceive of themselves as professionals and free individuals. More importantly, these ideas determine how scientists approach scientific activity, which exists in a social context, and which ultimately has the potential to dramatically change the characteristics of civilization as it is played out on the political and technological battlefield. It is a commonly held notion in the community of the natural sciences that science now is essentially what it was when it was described by the Nobel laureates of the past; those sweet, cushioning, pleasant words consecrating the ‘temple of science’; the picture of a humble, rational, and noble Einstein is imprinted into our memories. By dismantling these obsolete myths of the scientist and surveying contemporary trends in science, this article will explore a more realistic perspective toward the field of science. The goal of this investigation is to determine the modern reality and ultimate meaning of ‘science as a vocation’ (Shorett 2003). Finally, moral philosophy will be demonstrated to be a critical clement in the self-assertion of the scientist and the elucidation of the meaning of science as a vocation in a global technological society. -/- From the Postscript, 2015: This article took final form when I was a postdoctoral researcher in Canada. Reading it now, I recognize the article still has value, despite its many flaws, hyperboles, and idealism. W. Adorno, Aesthetic TheoryAdorno's philosophy as a whole, and his aesthetic theory in particular, is irrevocably bound to the tradition and achievements of high modernism. Although Adorno himself did not recognize American Abstract Expression as the apotheosis of high modernism in painting, that judgment now hardly seems contentious.1 And that raises a problem: it is the problem of R. Mutt, again, the problem of the porcelain urinal called Fountain, which was refused admittance to the Society of Independent Artists' Exhibition in April 1917 in spite of the Society's proclaimed democratic slogan "No jury, no prizes"—the work whose life or after-life begins with the beautiful photograph of it by Stieglitz set against the background of Marsden Hartley's The Warriors and that appeared shortly thereafter in the new avant-garde journal The Blind Man. Whatever the immediate repercussions of Fountain, there can be little doubt that much of what is most vital in art in the second half of this century is unthinkable without it; Duchamp's readymade offers an exemplary alternative to the tradition of high modernist painting that has continued to be generative. For a modernist like Adorno, for whom authentic art is that which best rises to the demands and necessities of artistic materials, for whom internal consistency and rigor would appear to be everything, for whom, finally, aesthetic form is the "objective organization within each artwork of what appears as bindingly eloquent" [AT 143; emphasis mine], Duchamp's gesture of simply naming or claiming artistic status for an ordinary bathroom fixture must be anathema. In this respect, Adorno's aesthetic theory would seem to be in the same predicament as Clement Greenberg's modernism: inextricably bound to a tradition that history has left behind. And while the option of refuting the claim of Fountain is certainly possible, and should not be too quickly suppressed (there is something in the claim that will forever be skeptically self-defeating), nonetheless there does appear to be an exemplariness to Fountain that exceeds the narrow provocation of Duchamp's nominalist gesture; something in the readymade, in fact, seems (art historically? aesthetically? conceptually?) irresistible. If so, then modernist [End Page 83] formalism must either find a way of accommodating the readymade without departing from its internal logic or find its claim to our attention forfeited.After laying out the bold outlines of Adorno's formalism, the remainder of this essay will seek to uncover an account of the readymade in the context of what I will eventually call "the paradox of modernism" in order to locate in what way the readymade can be accommodated to a defense of Adorno's late modernism. For the purposes of this argument, I am going to assume that the best overall defense of Duchamp's gesture, which makes it foundational for the understanding of modern art, is that offered by Thierry de Duve in his Kant after Duchamp. My elaboration of Adorno's late modernism will hence proceed, in part, through a charting of some of the fault lines in de Duve's Duchamp. While the image of the slave as the antithesis of the freeman is central to republican freedom, it is striking to note that slaves themselves have not contributed to how this condition is understood. The result is a one-sided conception of both freedom and slavery, which leaves republicanism unable to provide an equal and robust protection for historically outcast people. I draw on the work of Frederick Douglass – long overlooked as a significant contributor to republican theory – to show (...) one way why this is so. Focusing the American Revolution, the subsequent republican government established new political institutions to maintain the collective interests of the whole population. The political revolution was held in place by processes of public reason that reflected the values and ideas of the people that had rebelled. The black population, however, had not been part of this revolution. After emancipation, black Americans were required to accept terms of citizenship that had already been defined, leaving them socially dominated, subject to the prejudices and biases within the prevailing ideas of public discourse. Douglass argued that republican freedom under law is always dependent on a more fundamental revolution, that he calls a ‘radical revolution in thought’, in which the entire system of social norms and practices are reworked together by members of all constituent social groups – women and men, black and white, rich and poor – so that it reflects a genuinely collaborative achievement. Only then can we begin the republican project of contestatory freedom as independence or non-domination that today’s republicans take for granted. (shrink)

Clark and Chalmers (1998) defend the hypothesis of an ‘Extended Mind’, maintaining that beliefs and other paradigmatic mental states can be implemented outside the central nervous system or body. Aspects of the problem of ‘language acquisition’ are considered in the light of the extended mind hypothesis. Rather than ‘language’ as typically understood, the object of study is something called ‘utterance-activity’, a term of art intended to refer to the full range of kinetic and prosodic features of the on-line behaviour of (...) interacting humans. It is argued that utterance activity is plausibly regarded as jointly controlled by the embodied activity of interacting people, and that it contributes to the control of their behaviour. By means of specific examples it is suggested that this complex joint control facilitates easier learning of at least some features of language. This in turn suggests a striking form of the extended mind, in which infants’ cognitive powers are augmented by those of the people with whom they interact. (shrink)

Richard Swinburne defends the classical Christian understanding of heaven and hell, arguing that it is both philosophically plausible and compatible (...) with the Christian conception of God's goodness. Philip Quinn proposes a defensible version of the classical assertion that God's conserving a creature in existence is tantamount to his continuously creating that creature. Thomas Flint and Alfred Freddoso present an analysis of omnipotence which they claim to be both philosophically adequate and consonant with the orthodox Christian belief that God is both omnipotent and incapable of sinning. James Ross's main purpose is to dislodge the assumption that God's power is properly and adequately thought of as the power to cause (or bring about or actualize) states of affairs. Clement Dore reinterprets and defends Descartes' often maligned Fifth Meditation argument for God's existence. After a period during which the theological categories of sin and forgiveness were ignored or trivialized, presently these notions are being rediscovered. What could their impact be on bioethics, either in the narrow sense of medical ethics, or in the more encompassing sense of the ethics of the life sciences? This essay begins with describing the processes of transcending and ethitization, which gave rise to the biblical notion of sin. It portrays the theological foundation of sin in terms of a (...) twofold refusal of proper relations to God and other humans. Through the practise of confession in the face of God (coram deo), sin is placed into a horizon of hope for forgiveness and reconciliation. The heuristic and hermeneutical significance of these categories results from their introducing a “surplus value,” which transcends biological and ethical considerations. This additional dimension is illustrated in view of care (cura) for the injured, and in view of individual as well as collective willingness to forgive. (shrink)
